1. Introduction & Acceptance of Terms

These Terms of Service (the "Terms") govern your access to and use of OnExaminer.com, including all related content, features, mock tests, services, and functionality offered on or through the OnExaminer online exam practice platform (collectively, the "Service"). By accessing or using OnExaminer.com in any way, including by creating an account, purchasing a mock test, or browsing the website, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

If you do not agree with any part of these Terms, you must not use the Service. You should read these terms and conditions carefully, as they contain important information about your legal rights and obligations when using our online exam practice and test preparation platform.

OnExaminer does not administer any official exams and is not affiliated with, endorsed by, or sponsored by any of the exam owners or administrators.

3. Eligibility

By accessing or using the Service, you represent and warrant that:

• You are at least 13 years of age; and
• If you are between 13 and the age of majority in your jurisdiction, you have obtained consent from your parent or legal guardian to use the Service; and
• You have the full power and authority to agree to these Terms and to use the Service; and
• You are not prohibited from using the Service under any applicable law.

If you are using the Service on behalf of another person or entity (such as a student, school, or organization), you represent that you have the authority to bind that person or entity to these Terms, and that such person or entity agrees to be responsible to us if you or the other person or entity violates these Terms.

To access certain features of the OnExaminer online exam practice platform, including purchasing and taking mock tests, you may be required to create an account.

Account Registration

When you create an account, you agree to provide accurate, current, and complete information as requested, and to promptly update such information if it changes. You may not use false information or create an account for anyone other than yourself without proper authorization.

Account Security

You are responsible for maintaining the confidentiality of your login credentials, including your username and password, and for restricting access to your account and devices. You agree to notify us immediately at support@onexaminer.com if you suspect any unauthorized access to or use of your account.

Responsibility for Account Activity

You are solely responsible for all activities that occur under your account, whether or not authorized by you. OnExaminer is not liable for any loss or damage arising from your failure to protect your account information or from any unauthorized use of your account.

5. Products & Payments

Mock Tests and Inclusions

OnExaminer provides online mock tests and practice questions for a variety of standardized exams. When you purchase access to a specific exam mock test, you are purchasing a limited, non-transferable, non-exclusive license to access that digital content through your OnExaminer account for your personal, non-commercial use.

Unless otherwise stated at the time of purchase, each mock test generally includes:

• One full-length online mock test for the selected exam;
• Access to the test through the OnExaminer platform for a specified period;
• Automated scoring or performance feedback where available; and
• Answer keys or explanations where provided as part of the product description.

Pricing

Unless otherwise indicated, each individual exam test available through OnExaminer.com is priced at $4.99 (USD) per mock test. Prices may be displayed in other currencies for convenience, but all charges will be processed in the currency specified at checkout. We reserve the right to modify pricing at any time; however, any price changes will not affect orders that have already been completed.

Payments and Billing

Payments for our online exam practice products are processed securely through third-party payment processors. By submitting your payment information, you authorize us and our payment processors to charge the applicable fees to your selected payment method. You represent and warrant that you have the legal right to use the payment method you provide.

OnExaminer does not store your full payment card details on our servers. All payment information is handled in accordance with industry-standard security practices by our third-party processors. You are responsible for any charges, fees, taxes, or other amounts imposed by your payment provider in connection with your purchase.

6. Refund Policy

We want you to be satisfied with your experience on our test preparation platform. However, because our products are digital and accessible immediately after purchase, we have a limited refund policy.

Eligibility for Refunds

Subject to applicable law, you may be eligible for a refund of the purchase price of a mock test under the following conditions:

• You submit a refund request to support@onexaminer.com within 24 hours of your purchase; and
• You have not started or accessed the purchased mock test in any way (including opening the test interface or viewing questions).

No Refunds After Test Access

Once you begin or access a mock test, including partial access to questions or sections, the sale is considered final and no refunds will be provided, except where required by applicable law. This policy is necessary because digital exam content can be viewed, copied, or used immediately upon access.

How to Request a Refund

To request a refund that meets the criteria above, please contact us at support@onexaminer.com with your name, account email address, order details, and a brief explanation. We may require additional information to verify your identity and eligibility. Approved refunds will be processed to your original payment method within a reasonable time, subject to your payment provider's policies.

7. Intellectual Property

All content on OnExaminer.com and within the Service, including but not limited to practice questions, mock tests, explanations, text, graphics, logos, icons, images, audio or video clips, software, user interface elements, and the overall design and layout (collectively, the "Content"), is owned by or licensed to OnExaminer and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Content strictly for your personal, non-commercial exam preparation. Except as expressly permitted by these Terms or applicable law, you may not, and you agree not to:

• Copy, reproduce, modify, adapt, translate, or create derivative works of any Content;
• Distribute, share, publish, resell, or otherwise make the Content available to any third party;
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
• Use any Content for commercial purposes, including paid tutoring, coaching, or test preparation services; or
• Use our trademarks, logos, or brand elements without our prior written consent.

All rights not expressly granted to you in these Terms are reserved by OnExaminer and its licensors.

8. Acceptable Use Policy

When using OnExaminer.com and our online exam practice services, you agree to comply with all applicable laws and to use the Service only for lawful, personal test preparation purposes. You must not use the Service in any way that could harm us, other users, or the integrity of any exam.

Prohibited Activities

Without limiting the generality of the foregoing, you agree that you will not:

• Use the Service to cheat on any official exam, or to assist others in cheating or violating exam rules;
• Share, post, upload, or distribute OnExaminer mock test questions, answers, or explanations to any third party or platform;
• Attempt to reverse engineer, decompile, disassemble, or otherwise access the source code or internal structure of the platform;
• Use automated tools, bots, scripts, or scraping technologies to access, query, or extract data from the Service;
• Circumvent, disable, or otherwise interfere with any security or access controls;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Interfere with or disrupt the operation of the Service, including by introducing viruses, malware, or harmful code;
• Use the Service for any commercial purpose, including selling access, sharing your account, or using our Content in paid courses or tutoring services; or
• Engage in any activity that may damage, disable, overburden, or impair the Service or our systems.

We reserve the right to investigate and take appropriate action, including suspending or terminating accounts, where we suspect any violation of this Acceptable Use Policy or these Terms.

9. Disclaimers

The OnExaminer online exam practice platform and all Content are provided for educational and informational purposes only. Our mock tests are designed to simulate exam conditions and provide practice for test-takers, but they are not official exams and may not reflect the exact content, difficulty, or scoring of any real exam.

OnExaminer makes no representation or warranty that your use of the Service, completion of mock tests, or performance on our practice questions will result in any particular score, outcome, or admission result on any official exam or at any educational institution. Your actual exam performance depends on a variety of factors beyond our control.

To the fullest extent permitted by applicable law, the Service and all Content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall OnExaminer, its owners, directors, officers, employees, contractors, or affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of (or inability to access or use) the Service or any Content, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

To the extent that our liability cannot be excluded under applicable law, our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amount you paid to OnExaminer for the specific mock test or product giving rise to the claim, or (b) fifty U.S. dollars (USD $50.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless OnExaminer, its owners, directors, officers, employees, contractors, and affiliates from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service or any Content;
• Your violation of these Terms or any applicable law;
• Any information or content you submit, upload, or transmit through the Service; or
• Your infringement or misappropriation of any intellectual property, privacy, or other rights of any third party.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claims.

13. Termination of Access

We may, in our sole discretion and without prior notice, suspend or terminate your access to the Service, or any part thereof, for any reason or no reason, including but not limited to:

• Behavior that may harm OnExaminer, other users, or any third party; or
• Requests by law enforcement or other government authorities.

Upon termination, your right to access and use the Service, including any purchased mock tests, may immediately cease. To the extent permitted by law, we are not obligated to provide any refunds or compensation in connection with termination, except as required by applicable law or our Refund Policy.

Certain provisions of these Terms that by their nature should survive termination (including, without limitation, provisions relating to intellectual property, disclaimers, limitations of liability, and indemnification) will continue to apply even after your access is terminated.

14. Governing Law

These Terms and your use of the OnExaminer online exam practice platform shall be governed by and construed in accordance with the laws of the jurisdiction in which OnExaminer is established, without regard to its conflict of law principles.
